Energy Performance of Buildings Directive

Introduction

Directive (EU) 2024/1275, known as the recast Energy Performance of Buildings Directive (EPBD), is a cornerstone of the EU's 'Fit for 55' package. Adopted on April 24, 2024, and repealing the previous Directive 2010/31/EU, this legislation aims to substantially improve the energy efficiency of the European building stock. Its primary objective is to achieve a fully decarbonized, zero-emission building stock by 2050, ensuring that buildings contribute to the EU's climate neutrality goals. The directive introduces higher standards for new buildings, mandates renovation rates for the worst-performing existing buildings, and promotes the integration of renewable energy, smart technologies, and sustainable mobility infrastructure.

Main Goal

The overarching goal is to transform existing buildings into zero-emission buildings by 2050 and to ensure all new buildings meet zero-emission standards by 2030. It seeks to reduce operational greenhouse gas emissions, address energy poverty, improving indoor environmental quality, and decrease the Union's energy dependency on fossil fuels.

Who It Applies To

This Directive applies to:

  • Member States (responsible for transposition and national plans).
  • Building Owners (public and private, residential and non-residential).
  • Construction and Real Estate Sectors (developers, renovators, architects).
  • Financial Institutions (mortgage lenders, green finance).
  • Tenants and Occupants (regarding energy costs and transparency).

Key Provisions

Zero-Emission Buildings (ZEB)

  • Establishes the Zero-Emission Building standard as the new norm for new construction. A ZEB requires zero or very low energy, covered significantly by renewables, and produces zero on-site carbon emissions from fossil fuels.

Minimum Energy Performance Standards (MEPS) & Trajectories

  • Non-Residential Buildings: Member States must renovate the 16% worst-performing buildings by 2030 and the 26% worst-performing by 2033.
  • Residential Buildings: Member States must achieve a reduction in the average primary energy use of the residential stock by 16% by 2030 and 20-22% by 2035, with a focus on renovating the worst-performing stock (43% of savings must come from these).

Solar Energy Mandate

  • Requires the deployment of suitable solar energy installations on new buildings, public buildings, and existing non-residential buildings undergoing renovation, following a phased timeline.

Phasing Out Fossil Fuels

  • Member States must outline plans to phase out fossil fuels in heating and cooling, with a view to a complete phase-out of fossil fuel boilers by 2040.
  • From 2025, subsidies for stand-alone fossil fuel boilers are prohibited.

Whole Life-Cycle Carbon

  • Requires the calculation and disclosure of the Global Warming Potential (GWP) over the building's life cycle for new buildings, starting with large buildings in 2028.

Enabling Tools

  • Renovation Passports: Voluntary schemes to provide roadmaps for deep renovation.
  • Energy Performance Certificates (EPCs): Harmonization of EPC classes (A to G) and improved reliability.
  • Smart Readiness Indicator (SRI): Assessment of a building's capacity to use ICT to adapt to occupant needs and the grid.
  • Sustainable Mobility: Requirements for EV recharging points and bicycle parking.

Exemptions

Member States may exempt certain categories from specific obligations (like MEPS or EPCs), including:

  • Officially protected buildings (heritage/historical).
  • Places of worship.
  • Temporary buildings (use time ≤ 2 years).
  • Residential buildings used less than 4 months/year.
  • Stand-alone buildings < 50 m².
  • Military/Defense buildings.

Penalties

Member States are required to lay down rules on penalties applicable to infringements of national provisions adopted pursuant to this Directive. These penalties must be effective, proportionate, and dissuasive. Specific penalties will vary by national transposition but may include fines for non-compliance with renovation obligations or failure to provide valid EPCs.

Implementation timeline for businesses and stakeholders:

* **1 January 2025**: **Subsidies Ban**. Member States must cease providing financial incentives for the installation of stand-alone fossil fuel boilers.
* **29 May 2026**: **Transposition Deadline**. Member States must bring laws, regulations, and administrative provisions into force to comply with the Directive.
* **31 December 2026**: **Solar Mandate (Phase 1)**. Requirement for solar energy installations on all **new public and non-residential buildings** with a useful floor area > 250 m².
* **31 December 2027**: **Solar Mandate (Phase 2)**. Requirement for solar energy on **existing public buildings** > 2,000 m² and existing non-residential buildings > 500 m² undergoing major renovation.
* **1 January 2028**: **ZEB for Public Bodies**. All **new buildings** owned by public bodies must be Zero-Emission Buildings. **Life-cycle GWP** calculation required for new buildings > 1,000 m².
* **31 December 2028**: **Solar Mandate (Phase 3)**. Requirement for solar energy on **existing public buildings** > 750 m².
* **31 December 2029**: **Solar Mandate (Phase 4)**. Requirement for solar energy on all **new residential buildings** and new roofed car parks.
* **1 January 2030**: **ZEB for All New Buildings**. All new buildings (private and public) must be Zero-Emission Buildings. **Life-cycle GWP** calculation required for **all new buildings**.
* **2030**: **MEPS Non-Residential**. Member States must ensure all non-residential buildings are below the **16% worst-performing threshold**. **Residential Target**: Reduce average primary energy use by **16%**.
* **31 December 2030**: **Solar Mandate (Phase 5)**. Requirement for solar energy on **existing public buildings** > 250 m².
* **2033**: **MEPS Non-Residential**. Member States must ensure all non-residential buildings are below the **26% worst-performing threshold**.
* **2035**: **Residential Target**. Reduce average primary energy use by **20-22%**.
* **2040**: **Fossil Fuel Phase-out Goal**. EU target date for the complete phase-out of fossil fuel boilers in buildings.
* **2050**: **Zero-Emission Stock**. The entire national building stock should be transformed into zero-emission buildings.
