Regulation (EU) 2023/1542 (the Batteries Regulation) is a comprehensive legislative framework that modernizes EU rules on batteries and waste batteries. It repeals the previous Directive 2006/66/EC and aims to promote a circular economy by regulating the entire life cycle of batteries—from design and material sourcing to manufacturing, usage, and end-of-life management. This Regulation is a key component of the European Green Deal and the Circular Economy Action Plan.
The primary objectives are to ensure that batteries placed on the EU market are sustainable, high-performing, and safe, while minimizing their environmental impact. It seeks to harmonize rules for all battery types to ensure a functioning internal market and to establish a circular economy for battery materials.
The Regulation applies to all categories of batteries placed on the market or put into service within the Union, regardless of their origin (imported or EU-made). This includes:
It applies to all economic operators in the supply chain: manufacturers, importers, distributors, and fulfilment service providers.
Member States are responsible for laying down rules on penalties for infringements. These penalties must be effective, proportionate, and dissuasive. Penalties may be enforced for non-compliance with substance restrictions, labeling failures, lack of due diligence, or failure to meet EPR obligations.
